Rules for Objects Independently Managed by the Owner

Owner Rules (self-managed properties)

These rules govern the relationship between the owner (hereinafter – „Owner“) and MB „Breda LT“ (hereinafter – „Platform“), when the Owner independently manages the property they publish on the Platform.

1. General provisions

  • By using the Platform, the Owner confirms that they are the lawful owner of the property or have all necessary authorisations to offer the property for short-term rental and to conclude related transactions.
  • The Owner confirms that offering the property for rent, its use and the provision of accommodation services do not violate applicable laws, the rights of third parties, community rules, rental agreements, internal rules or other restrictions binding on the Owner.
  • By using the Platform, the Owner confirms that they have read these rules, understand them and undertake to comply with them.

2. Role of the Platform

  • The Platform provides technical and organisational infrastructure for the Owner to publish the property, manage its visibility, accept or reject bookings according to the applicable model, administer the booking process and, where applicable, manage payment collection and disbursements.
  • In the owner-managed model, the Owner personally manages their property's content, availability, pricing, booking acceptance logic, cancellation conditions and communications, except for those areas the Platform administers under these rules or technical processes.
  • The Platform acts as an intermediary between the Owner and the client, but, unless explicitly stated otherwise, is not a party to the accommodation contract between the Owner and the client.

3. Property information and listing content

  • The Owner undertakes to provide accurate, correct, comprehensive and continuously updated information about the property.
  • The Owner is responsible for all data presented in the listing, including property descriptions, photos, rules, prices, occupancy, check-in and check-out times, cancellation conditions and other information related to the property offer.
  • It is prohibited to provide misleading, inaccurate, outdated or untruthful information.
  • The Platform has the right to require the Owner to clarify or update the property information and, if this is not done, to temporarily restrict the property's visibility or suspend its listing.

4. Legality and Owner's responsibility

  • The Owner is fully responsible for the condition, safety, suitability for accommodation, hygiene, fire safety, public order, taxes, registration, consumer protection and compliance with other applicable laws of the property.
  • The Owner assumes full responsibility for relations with clients related to the actual provision of the accommodation service, the condition of the property, terms of use and the enforcement of rules established by the Owner.
  • The Platform is not liable for disputes between the Owner and the client, except to the extent explicitly provided by applicable law or the Platform's procedures.

5. Booking management

  • An owner-managed property may be subject to automatic booking confirmation or an Owner approval model, depending on the Platform's settings and the specific property configuration.
  • If the property is subject to Owner approval, the Owner must respond to booking requests within a reasonable time and must not delay a decision without justified reason.
  • If the property is subject to automatic confirmation, the Owner is obliged to ensure that the property's calendar, prices and conditions are continuously accurate and up to date.
  • The Owner may not unilaterally ignore a valid booking or refuse to honour it without a lawful and justified reason.
  • If the Owner cannot fulfil a confirmed booking, they must immediately inform the Platform and cooperate in finding a solution for the client.

6. Payments and commission fee

  • If a specific offer is subject to payment through the Platform, payments for bookings are collected through the Platform or its payment service provider.
  • All payments for bookings subject to the Platform's payment procedure must be made only through the Platform.
  • The Owner is prohibited from accepting payments directly from clients outside the Platform if a specific offer is subject to payment through the Platform.
  • The Platform applies an 8% commission fee on the amount of each reservation, unless otherwise provided for a specific offer or separate agreement.
  • The commission fee is deducted from the amount payable to the Owner, unless the Platform expressly specifies a different calculation or deduction procedure.

7. Payouts to the Owner

  • Payouts to the Owner are made to the account specified by the Owner or via the payment service provider used by the Platform according to the Platform's established procedure.
  • The Owner must provide accurate and complete data required for payment administration, identity verification, tax or compliance requirements.
  • The Platform has the right to withhold, delay or adjust a payout if there are suspicions of rule violations, fraud, disputes, refunds, chargebacks, technical errors, legal requirements or other justified risks.
  • The Platform is not liable for payout delays if they arise from incorrect Owner data, actions of third-party payment service providers, legal checks or other circumstances reasonably beyond the Platform's control.

8. Cancellation conditions, refunds and disputes

  • The Owner sets their property's cancellation conditions to the extent permitted by the Platform's technical capabilities, applicable laws and the Platform's rules.
  • The Owner is responsible for ensuring that the conditions they set are clear, fair and consistently applied.
  • Refunds to clients, where applicable, are processed through the Platform or its payment service provider in accordance with applicable rules, the dispute resolution decision and the circumstances of the specific booking case.
  • The Platform has the right to mediate in resolving disputes between the Owner and the client, collect information, request explanations and make decisions on temporary fund holds to the extent necessary for dispute investigation.

9. Prohibition of contact information and redirection

  • The Owner is prohibited from providing any contact information in the listing, photos, descriptions, documents or other Platform fields, including phone numbers, email addresses, social media accounts, links to external websites or other data that would allow the client to contact the Owner outside the Platform.
  • The Owner is prohibited from encouraging the client in any way to pay, book or communicate outside the Platform if the specific offer is subject to the Platform's booking or payment process.
  • The Platform has the right to edit, hide or remove such content without prior notice.
  • Repeated or significant violations may result in listing suspension, account restriction, withholding of payouts or termination of cooperation.

10. Rights of the Platform

  • The Platform has the right to suspend, hide, reject or remove a listing if it violates these rules, laws, third-party rights, public order or the Platform's technical and quality standards.
  • The Platform has the right to temporarily or permanently restrict the Owner's account if rule violations, signs of fraud, client deception, circumvention of payment procedures, repeated disputes or other significant risks to the Platform, clients or third parties are detected.
  • The Platform has the right to change property display priorities, moderate content, suspend listing publication or request additional data and documents if necessary to ensure legality, quality or trust.

11. Taxes and accounting

  • The Owner is solely responsible for fulfilling tax, fee, accounting, reporting and other legal and financial obligations related to their activities, unless otherwise expressly stated.
  • The Platform is not responsible for calculating, reporting or paying the Owner's tax liabilities, except where directly required by applicable law or a separate written agreement.

12. Limitation of liability

  • To the extent permitted by applicable law, the Platform is not liable for indirect losses, lost profits, reputational damage, lost bookings or other indirect consequences related to the use of the Platform.
  • The Platform is not liable for client actions or inactions, actions of third-party payment service providers, technical malfunctions, force majeure circumstances or other events reasonably beyond the Platform's control.
  • No provision of these rules limits liability in cases where such limitation is not permitted by applicable law.

13. Personal data and cooperation

  • When using the Platform and processing booking-related data, the Owner must comply with applicable personal data protection laws.
  • The Owner has no right to use client data for purposes other than booking administration, provision of the accommodation service and fulfilment of legal obligations, unless there is another lawful basis.
  • The Owner must cooperate with the Platform when necessary for investigating disputes, complaints, legal requests, identity verifications, payment checks or security incidents.

14. Amendment of the rules

  • The Platform has the right to amend these rules when necessary for legal, technical, security or business reasons.
  • Material changes take effect from their publication on the Platform or from a later date specified in the rules or notice.
  • Continued use of the Platform after the rules come into effect is considered acceptance of the updated version, except where applicable law provides otherwise.

15. Applicable law and dispute resolution

  • These rules are governed by the law of the Republic of Lithuania, except where mandatory laws provide otherwise.
  • All disagreements shall first be resolved through negotiations in order to find an amicable solution.
  • If a dispute cannot be resolved amicably, it shall be resolved by a competent authority or court in accordance with applicable law.

16. Final provisions

By using the Platform, the Owner confirms that they understand the Platform's role, the essence of the owner-managed model, the principles of payment administration, the responsibility for booking management and agree to these rules.
