Client Rules

Client Rules

These rules govern the relationship between the client (hereinafter – "Client") and MB "Breda LT" (hereinafter – "Platform") when using the short-term rental services offered on the Platform.

1. General Provisions

  • The Platform provides the Client with the ability to search for short-term rental properties, submit booking requests, make reservations and, where applicable, make payments through the Platform.
  • The Platform is not the owner or manager of the rented property, except where this is expressly indicated in the description or additional terms of a specific property.
  • Accommodation services are provided to the Client by the owner of the specific property or its authorized manager (hereinafter – "Owner").
  • By using the Platform, the Client confirms that they have read these rules, understand them and undertake to comply with them.
  • The Client may use the Platform only for lawful purposes and only if they have the right to enter into binding legal transactions under applicable law.

2. The Platform's Role

  • The Platform acts as an intermediary between the Client and the Owner, enabling the discovery of a property, initiating a reservation, administering the reservation process and, where applicable, administering payments.
  • Unless otherwise stated in the terms of a specific property or offer, contractual accommodation relations regarding the actual provision of accommodation arise between the Client and the Owner.
  • The Platform is not responsible for the accuracy of the data provided by the Owner, the actual condition of the property, its suitability for the Client's specific needs or the actual performance of the accommodation service, except where such liability is expressly provided by applicable law.

3. Registration and Account Use

  • When using the Platform, the Client must provide correct, accurate and complete information.
  • The Client is responsible for the security of their account, login credentials and the devices used.
  • The Client must immediately inform the Platform of any suspected unauthorized access to the account or other security breach.
  • The Platform has the right to restrict, suspend or terminate the Client's account if violations of these rules, applicable laws or requirements based on the principles of fair use are detected.

4. Property Information and Offers

  • Property descriptions, prices, photos, rules, availability, cancellation terms and other information are provided on the Platform based on data uploaded by the Owner or the Platform administrator.
  • The Platform strives to ensure that the information provided is as accurate and up-to-date as possible, but does not guarantee that it will be free of inaccuracies, technical errors or changes.
  • If, after submitting a reservation, it becomes apparent that the information for a specific property was clearly incorrect or the property can no longer actually be provided, the Platform and/or the Owner have the right to reject or cancel the reservation, and the Client will be refunded the amounts actually paid according to the applicable conditions.

5. Reservation Process

  • The Client may submit a booking request or make a reservation according to the booking model specified for a specific property on the Platform.
  • If a specific property is subject to automatic confirmation (instant booking), the reservation is considered confirmed only after the Client successfully makes the payment through the Platform.
  • If a specific property requires Owner confirmation, the reservation is considered confirmed only when the Owner confirms the reservation and the Client successfully makes the payment through the Platform.
  • Until payment has been successfully received and, where applicable, the Owner's confirmation, the reservation is not considered valid and does not create a right for the Client to demand the provision of accommodation services.
  • The Platform or the Owner may reject a booking request if it does not comply with the property's rules, availability, legal requirements or there are other justified reasons.

6. Payments

  • If payment through the Platform is required for a specific offer, all payments for the reservation must be made only through the Platform.
  • The Client is prohibited from circumventing the Platform's booking or payment procedure when payment through the Platform is required for a specific offer.
  • The Platform may use third-party payment service providers to accept, process, refund or otherwise handle payments related actions.
  • The Platform has the right to refuse to accept a payment, suspend the execution of a reservation or initiate additional verification if there are suspicions of fraud, unlawful use of a payment method or other risk circumstances.

7. Prices, Fees and Additional Conditions

  • The price and payment terms applicable to the Client are stated at the time of booking.
  • Additional conditions for a specific property, including arrival, departure, usage, deposit, additional services or other requirements, may be specified in the property description or during the booking process.
  • The Client must review the specific property's conditions before confirming the reservation, as they may vary depending on the Owner or property type.

8. Cancellations, Modifications and Refunds

  • Cancellation, modification and refund conditions are determined according to the rules specified in the offer for the specific property, as well as according to applicable laws.
  • Unless otherwise stated in the offer, the Client must familiarize themselves with the specific property's cancellation conditions before making a reservation.
  • Refunds, where applicable, are processed through the Platform or the payment service provider used according to applicable rules and technical possibilities.
  • The actual refund period may depend on the payment method, the payment service provider or the procedures of the financial institution.
  • In the event of a dispute, the Platform may mediate between the Client and the Owner, but this does not in itself mean that the Platform assumes the Owner's liability for the accommodation service.

9. Client Obligations and Liability

  • The Client undertakes to use the property with care, comply with the property's usage rules, public order, laws and any additional conditions set by the Owner.
  • The Client is responsible for the actions of themselves, accompanying persons, minors, guests or other persons using the property on their behalf, and for any damage they cause to the property, inventory or third parties.
  • The Client undertakes not to use the Platform for fraud, unlawful activity, providing false information, bypassing payment procedures or other dishonest use.

10. Prohibited Actions

  • The Client is prohibited from providing false, misleading or incomplete information during booking or registration.
  • The Client is prohibited from using other people's personal data, payment methods or accounts without a lawful basis.
  • The Client is prohibited from attempting to circumvent the Platform's technical, commercial or legal rules, including initiating direct payment or booking outside the Platform in cases where the offer is subject to the Platform's booking procedure.

11. Platform Rights

  • The Platform has the right to update, change, restrict or discontinue certain functions at any time if necessary for legal, technical, security or business reasons.
  • The Platform has the right to suspend, reject or cancel a reservation if there are reasonable suspicions of fraud, unlawful use, rule violations, a technical error or an obviously incorrect price or offer information.

12. Limitation of Liability

  • To the extent permitted by applicable law, the Platform is not liable for indirect losses, lost revenues, lost profits, loss of reputation or other indirect consequences related to the use of the Platform or the accommodation service.
  • The Platform is not responsible for the actions or omissions of third parties, including Owners and payment service providers, except to the extent that such liability is directly provided by mandatory law.
  • No provision of these rules limits liability in cases where such limitation is not permitted under applicable law.

13. Personal Data and Privacy

  • The Client's personal data are processed in accordance with the Platform's Privacy Policy and applicable personal data protection laws.
  • By using the Platform, the Client confirms that they have read the Privacy Policy or had the opportunity to read it before using the Platform or making a reservation.

14. Changes to the Rules

  • The Platform has the right to change these rules when necessary for legal, technical, security or business reasons.
  • Material changes take effect from their publication on the Platform or from a later date specified in the rules or notice.
  • Continued use of the Platform after the rules take effect is considered acceptance of the updated version of the rules, except where applicable law provides otherwise.

15. Applicable Law and Dispute Resolution

  • These rules are governed by the law of the Republic of Lithuania, except where consumer protection or other mandatory laws provide otherwise.
  • All disputes are first resolved through negotiations, aiming to find an amicable solution.
  • If a dispute cannot be resolved amicably, it will be resolved by a competent authority or court in accordance with applicable law.

16. Final Provisions

By using the Platform, the Client confirms that they understand the Platform's operating principles, the reservation confirmation procedure, the importance of payments for the validity of a reservation and agree to these rules.
